Apex Agent Terms and Conditions

Please read these Terms and Conditions (“Terms”, “Terms of Service”) carefully before using the Apex Agent mobile application (the “Service”, “App”) operated by Cybertek Dynamics (“us”, “we”, “our”, or “Cybertek”).

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.

1. Acceptance & Scope of Terms

These Terms govern your use of the Apex Agent mobile application and any related services, documentation, or software interfaces provided by Cybertek Dynamics.

2. User Responsibilities & Self-Hosted Infrastructure

Apex Agent operates on a “Bring Your Own Infrastructure” (BYOI) architecture.

  • Self-Hosted Backend Requirements: You acknowledge that Apex Agent requires an active connection to an external, self-hosted AI Gateway or local Large Language Model provider (e.g., Ollama). You are solely responsible for the installation, setup, hardware maintenance, security configuration, and any operational costs associated with your private server.

  • Security & Access Credentials: You are responsible for maintaining the confidentiality and security of your secret passkey, API keys, and endpoint network routing. Cybertek Dynamics is not responsible for unauthorized access to your self-hosted instance.

  • Compliance & Data Privacy: Because you maintain direct ownership and physical/cloud control of your AI backend and data storage, you are solely responsible for ensuring that your server deployment complies with all applicable local, regional, and international privacy laws.

  • Lawful Use: You agree not to use Apex Agent for any unlawful, deceptive, or malicious activity, including but not limited to:

    • Initiating unauthorized access or network scraping against third-party endpoints.

    • Generating or transmitting unauthorized bulk text messages or spam via native device SMS integrations.

    • Violating applicable telecommunications, privacy, or data regulation standards.

3. Service Disclaimers & Limitations

  • AI Output & Non-Reliance: Apex Agent leverages artificial intelligence and Large Language Models (LLMs) to synthesize information and execute automated commands. AI models can produce errors, hallucinations, or inaccurate information. Cybertek Dynamics does not warrant, guarantee, or assume responsibility for the accuracy, completeness, reliability, or safety of any output generated by the AI model. You should independently verify any critical information provided by the Service.

  • Service Availability & Uptime: Because the application relies on your self-hosted hardware, personal home/cloud networks, and third-party APIs (such as Exa AI, or SearXNG), Cybertek Dynamics makes no guarantees regarding continuous, uninterrupted, or error-free app performance. We are not liable for downtime, latency, or service failures resulting from your server configuration or third-party API outages.

4. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Cybertek Dynamics, its directors, employees, partners, or agents be liable for any indirect, incidental, special, consequential, or punitive damages—including without limitation, loss of profits, lost data, hardware failure, service interruptions, or other intangible losses—resulting from:

  1. Your access to or use of (or inability to access or use) the Service.

  2. Any behavior, content, or outputs produced by your connected LLM / AI Gateway.

  3. Any third-party conduct or content integrated into the app via grounding or search features.

5. Intellectual Property

The Apex Agent application interface, software architecture, source code, logos, visual branding, and proprietary assets (excluding user-provided data, personal configurations, and outputs generated by third-party LLMs) remain the exclusive property of Cybertek Dynamics and its licensors.

6. Account & Access Termination

We reserve the right to suspend or terminate access to our application licenses or update distributions immediately, without prior notice or liability, if you breach these Terms or engage in illegal activities using the Service.

7. Governing Law

These Terms shall be governed, construed, and enforced in accordance with the laws of the jurisdiction in which Cybertek Dynamics is registered, without regard to its conflict of law principles.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Material changes will be communicated by updating the “Last Updated” date at the top of this document or via app settings documentation. Continued use of the Service following any changes constitutes acceptance of the revised Terms.
