GeoRecall Terms and Conditions

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the GeoRecall mobile application (the “App”) operated by Cybertek Dynamics (“us”, “we”, or “our”).

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.

1. Description of Service

GeoRecall is a local-first location management utility that allows users to securely save, organize, and recall geographic coordinates. The App is distributed under a freemium model, offering basic features for free alongside a premium lifetime upgrade (“Premium Tier”) that unlocks advanced utility.

2. In-App Purchases (Premium Tier)

  • Billing: We offer a “Premium” lifetime upgrade for a one-time fee. All transactions and billing cycles are securely managed and processed exclusively by the Google Play Store.

  • Refunds: Because all billing is managed by the distribution platform, all refund requests must be initiated and processed directly through the Google Play Store’s refund policies. Cybertek Dynamics does not directly handle, issue, or process financial refunds.

  • Features: Premium features include, but are not limited to: unlimited saved locations, high-precision GPS polling, custom category sorting, personal notes, custom map themes, and biometric vault security.

  • Licensing & Transferability: Your lifetime purchase is non-transferable and is permanently tied to the specific Google Play Account used to make the purchase.

3. Location Data and Privacy

  • Local-First Architecture: GeoRecall functions as a local-first application. All coordinates, labels, notes, and visual map snippets are stored and encrypted directly on your physical device. We do not host, store, back up, or transmit your saved locations on our external servers.

  • User Responsibility: Because we have zero access to your locally stored data, you are solely responsible for managing, exporting (e.g., via CSV), or backing up your data. We cannot retrieve, restore, or recover your saved location data if your physical device is lost, stolen, damaged, or factory reset.

  • Device Security: You are responsible for maintaining the physical and digital security of your device, including utilizing secure device screen locks and the App’s optional biometric vault configuration.

  • Accuracy Disclaimer: Geographic precision depends entirely on your physical device’s hardware sensors, surrounding satellite visibility, local cellular network status, and weather conditions. We do not guarantee 100% precision and accept no liability for issues, delays, or physical inconveniences arising from inaccurate coordinate readings.

4. Free Tier Restrictions

  • Data Purging: To optimize system resources and local storage on your device, users utilizing the Free tier agree that saved location data older than 90 days may be automatically purged from the app’s local database.

  • Coordinate Precision: Free tier users receive approximate location data (coordinates rounded to two decimal places) as a fundamental constraint of the free tier service. Upgrading to the Premium Tier is required for full, uncompromised decimal precision.

5. Prohibited Use

You agree not to use the App:

  • For any illegal, unauthorized, or dangerous purpose.

  • To track, monitor, stalk, or harass any individual without their explicit, prior consent.

  • In any manner that violates local, state, national, or international laws (including but not limited to geographic privacy and surveillance laws).

  • To attempt to reverse-engineer, modify, disrupt, or impair the core functionality of the App.

6. Intellectual Property

The App and its original source code, layout designs, visual interfaces, graphics, features, and brand styling (excluding user-saved local data points) are and will remain the exclusive intellectual property of Cybertek Dynamics. The App is protected by copyright, trademark, and intellectual property laws of both the United States and foreign jurisdictions.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Cybertek Dynamics, nor its sole proprietor, developers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, physical displacement, data loss, personal injury, device failure, or other intangible losses, resulting from:

  • Your access to, use of, or inability to access or use the App.

  • Any physical or real-world navigation choices made while utilizing coordinates obtained from the App.

  • Unauthorized access, alteration, or loss of your physical device and its local encrypted database.

8. Disclaimer of Warranties

Your use of the App is at your sole risk. The App is provided on an “AS IS” and “AS AVAILABLE” basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days’ notice prior to any material changes taking effect by updating the “Last Updated” date at the top of these Terms. What constitutes a material change will be determined at our sole discretion.
