1. Acceptance of Terms
Welcome to Cybertek Dynamics LLC!
By accessing our website (https://cybertekdynamics.com) or engaging our professional consulting and development services, you agree to be bound by these Terms and Conditions. These terms apply to all clients, users, and third-party stakeholders.
2. Professional Services & Hourly Rates
Cybertek Dynamics LLC provides specialized technical consultancy and full-stack engineering. All services are performed by a Senior Architect and are billed according to the following tier structure:
Strategy & Architecture: $150/hr (Discovery, Blueprints, Audits)
Engineering & Development: $135/hr (Coding, Database Build, Integration)
Managed Support: $95/hr (Maintenance, Security Updates)
3. Intellectual Property (IP) for Projects
This section defines the ownership of any "Projects" or "Developed Applications" created by Cybertek Dynamics LLC:
Client Deliverables: Upon receipt of full payment, the Client is granted ownership of the custom source code and specific business logic created specifically for their project.
Consultant Toolkits: Cybertek Dynamics LLC retains ownership of all pre-existing code libraries, proprietary "toolkits," and universal scripts used to facilitate the build. We grant the Client a perpetual, non-exclusive license to use these components within the project scope.
4. Payment & Late Fees
Invoicing: Services are invoiced bi-weekly or upon milestone completion.
Late Payments: Invoices not settled within 15 days are subject to a 5% late fee per month on the outstanding balance.
Project Suspension: We reserve the right to pause all technical development or server access if accounts remain past due for more than 30 days.
5. Security & Warranties
Cybertek Dynamics LLC implements standardized security best practices in every build.
Standard of Care: We perform services with the professional care and skill expected of a Senior Systems Architect.
No Absolute Guarantee: While we prioritize hardened infrastructure, we do not warrant that software will be 100% error-free or impenetrable by unauthorized third-party access.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF CYBERTEK DYNAMICS LLC FOR ANY CLAIM ARISING FROM OUR SERVICES OR THIS WEBSITE SHALL NOT EXCEED THE TOTAL FEES PAID BY THE CLIENT TO CYBERTEK DYNAMICS LLC DURING THE THREE (3) MONTHS PRECEDING THE CLAIM. We are not liable for incidental, indirect, or "loss of profit" damages.
7. User Comments & Hyperlinking
Comments: We reserve the right to monitor and remove any user-posted comments that are deemed offensive or a breach of these terms.
Hyperlinking: Professional organizations may link to our home page provided the link is not deceptive and does not falsely imply sponsorship or endorsement.
8. Governing Law
These terms are governed by and construed in accordance with applicable laws. Any legal action or dispute arising from these terms shall be resolved in the appropriate jurisdiction where Cybertek Dynamics LLC is registered.
